Bullying and Harassment

Bullying and harassment can arise in many different ways at work. These could include:

  • Poor or aggressive management techniques which result in discomfort to the recipient, or public humiliation. For example, I was recently consulted about a case where the least successful employees in a call centre were subjected to a giant squid being dropped onto their face by colleagues when the weekly sales results were announced.
  • Undermining or picking on someone who is a reasonable worker
  • Denying training or promotion opportunities

It is often the case that employees who have suffered this type of bullying and harassment may be victims of unlawful discrimination contrary to the Equality Act.

Business managers may have no direct knowledge of the activities which are the subject of the allegation and a grievance raised by an employee can often be the first warning sign of a potential problem. Failing to deal with this type of grievance according to the correct policy not only compounds the problem, but may lead to a constructive dismissal claim.
